The Criminal Law includes several articles for intellectual property crime and the amendments increase the maximum sentencing term to up to 1o years. The amendments also add a new article somewhat similar to the US\u2019 <a href=\"https:\/\/www.justice.gov\/archives\/jm\/criminal-resource-manual-1122-introduction-economic-espionage-act\">Economic Espionage Act<\/a>\u00a0potentially in effect if not in wording.<!--more--><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-large wp-image-994\" src=\"http:\/\/www.chinaiplawupdate.com\/wp-content\/uploads\/2020\/12\/NPC-1024x473.jpg\" alt=\"\" width=\"840\" height=\"388\" srcset=\"https:\/\/www.chinaiplawupdate.com\/wp-content\/uploads\/2020\/12\/NPC-1024x473.jpg 1024w, https:\/\/www.chinaiplawupdate.com\/wp-content\/uploads\/2020\/12\/NPC-300x138.jpg 300w, https:\/\/www.chinaiplawupdate.com\/wp-content\/uploads\/2020\/12\/NPC-768x354.jpg 768w, https:\/\/www.chinaiplawupdate.com\/wp-content\/uploads\/2020\/12\/NPC.jpg 1079w\" sizes=\"(max-width: 709px) 85vw, (max-width: 909px) 67vw, (max-width: 1362px) 62vw, 840px\" \/><\/p>\n<p><span style=\"text-decoration: underline;\">Trademarks<\/span><\/p>\n<p>Article 213 increases the maximum fixed-term imprisonment for using the\u00a0same trademark as a registered trademark on the same kind of goods\u00a0or services\u00a0without the permission of the registered trademark owner from 7 years to 10 years when the circumstances are particularly serious.<\/p>\n<p>Article 214 increases the maximum fixed-term imprisonment for knowingly selling counterfeit trademark goods from 7 year to 10 years when the amount of illegal gains is huge or there are other particularly serious circumstances.<\/p>\n<p>Article 215 increases the maximum fixed-term imprisonment for manufacturing counterfeit trademark products from 7 to 10 years when the circumstances are particularly serious.<\/p>\n<p><span style=\"text-decoration: underline;\">Copyrights<\/span><\/p>\n<p>Article 217 increases the maximum fixed-term imprisonment from 7 to 10 years for copyright infringement for profit-making purposes where the amount of illegal gains is huge or there are other particularly serious circumstances.<\/p>\n<p><span style=\"text-decoration: underline;\">Trade Secrets<\/span><\/p>\n<p>For criminal theft of trade secrets, the maximum fixed-term imprisonment is increased from 7 years to 10 years in Article 219 if the circumstances are serious.\u00a0 Article 219 further revises the definition of theft as follows:<\/p>\n<blockquote>\n<p><span style=\"font-size: 12pt;\">(1) Obtaining the right holder\u2019s trade secrets by theft,\u00a0<del>inducement<\/del>,\u00a0bribery,\u00a0fraud, coercion,\u00a0electronic intrusion\u00a0or other improper means;<\/span><\/p>\n<p><span style=\"font-size: 12pt;\">\u2026<\/span><\/p>\n<\/blockquote>\n<p><span style=\"text-decoration: underline;\">Commercial Espionage<\/span><\/p>\n<p>New Article 219 adds a provision somewhat similar to the US\u2019 Economic Espionage Act and reads as follows:<\/p>\n<blockquote>\n<p><span style=\"font-size: 12pt;\">[Commercial Espionage Crime] Whoever steals, spies, buys, or illegally provides commercial secrets for institutions, organizations, or persons outside the country shall be sentenced to fixed-term imprisonment of not more than five years, and\/or a fine; if the circumstances are serious they shall be sentenced to more than five years in prison and fined.<\/span><\/p>\n<\/blockquote>\n<p>Accordingly, the term for imprisonment is open-ended and hypothetically longer than if the theft of trade secrets was for a domestic beneficiary.\u00a0<\/p>\n<p>Note that a key difference between this article and US\u2019 Economic Espionage Act (EEA) is that the beneficiary in the criminal law is any foreign beneficiary while the EEA requires the beneficiary to be a foreign instrumentality \u2013 \u201cany agency, bureau, ministry, component, institution, association, or any legal, commercial, or business organization, corporation, firm, or entity that is substantially owned, controlled, sponsored, commanded, managed, or dominated by a foreign government.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p class=\"excerpt\">On December 26, 2020, the Twenty-Fourth Meeting of the Standing Committee of the 13th\u00a0National People\u2019s Congress\u00a0of China voted to pass the \u201cAmendment to the Criminal Law of the People\u2019s Republic of China (11)\u201d (\u4e2d\u534e\u4eba\u6c11\u5171\u548c\u56fd\u5211\u6cd5\u4fee\u6b63\u6848\uff08\u5341\u4e00\uff09), which will go into effect on March 1, 2021.
