Once the parties respond to the order, the USPTO will determine whether to proceed with the sanctions identified in the order. The response, if any, may provide additional explanation or evidence that was not available to the USPTO when the initial investigation was made, and therefore, the show cause order should not be read as a final determination.<\/em><\/p>\n<p>On June 8, 2021, the <a href=\"http:\/\/uspto.gov\">United States Patent &amp; Trademark Office<\/a> issued an Order to Show Cause to Chinese Intellectual Property Law Firm Shenzhen Huanyee Intellectual Property Co., Ltd. with respect to providing false information in over 8,000 U.S. trademark applications. Specifically, the Order alleges Huanyee was &#8220;engaging in unauthorized practice before the USPTO in trademark matters, providing false information to the USPTO by means of entering the signatures of thousands of third parties on trademark submissions, and providing false, fictitious, or fraudulent information in trademark submissions with the intent to circumvent the USPTO Rules.&#8221; As a result, trademark applications prosecuted by Huanyee might be invalid.<!--more--><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-1539\" src=\"http:\/\/www.chinaiplawupdate.com\/wp-content\/uploads\/2021\/06\/Order.jpg\" alt=\"\" width=\"748\" height=\"974\" srcset=\"https:\/\/www.chinaiplawupdate.com\/wp-content\/uploads\/2021\/06\/Order.jpg 748w, https:\/\/www.chinaiplawupdate.com\/wp-content\/uploads\/2021\/06\/Order-230x300.jpg 230w\" sizes=\"(max-width: 709px) 85vw, (max-width: 909px) 67vw, (max-width: 984px) 61vw, (max-width: 1362px) 45vw, 600px\" \/><\/p>\n<p>The USPTO states that Huanyee is engaging in widespread unauthorized practice of law:<\/p>\n<blockquote>\n<p><span style=\"font-size: 12pt;\">Huanyee is a China-based organization that describes itself as specializing in registering trademarks in China. However, the company also boasts on the Huanyee website that it has filed more than 30,000 foreign trademark applications, including in the United States. While the Huanyee website also includes photographs of people identified as \u201cNyxia\u201d and \u201cGaulle,\u201d identifying them as \u201cU.S. attorneys,\u201d the USPTO is unaware of any U.S. trademark application or registration listing an email address associated with Huanyee that includes attorney information for any such persons. Indeed, the USPTO could not locate any information to suggest that you or any of your employees are attorneys qualified to practice before the USPTO in trademark matters.<\/span><\/p>\n<p><span style=\"font-size: 12pt;\">Between 2016 and 2019, you and your employees were routinely practicing before the USPTO in trademark matters, despite the fact that at all relevant times the USPTO Rules provided that only attorneys licensed in the United States are authorized to represent others. Available information indicates that you counseled and gave advice to clients in contemplation of filing a trademark application and other documents before the USPTO, prepared and prosecuted applications for trademark registration, prepared and submitted arguments and amendments in trademark matters, and communicated with the Office on behalf of clients. When completed by a non-attorney on behalf of a third party, each of these actions constitutes the unauthorized practice of law in violation of USPTO Rules. After the USPTO implemented the U.S. Counsel Rule on August 3, 2019, to require foreign-domiciled applicants in trademark matters before the USPTO to be represented by attorneys licensed to practice law in the United States, you and your employees violated this rule and continued to violate other USPTO Rules, including by concealing your involvement in the prosecution process. <\/span><\/p>\n<\/blockquote>\n<p>Further, Huanyee is responsible for improperly entering the<br \/>\nsignatures of others and providing false, fictitious, and\/or fraudulent<br \/>\ninformation in trademark submissions to the USPTO:<\/p>\n<blockquote>\n<p><span style=\"font-size: 12pt;\">The implementation of the U.S. Counsel Rule barred the practice of foreign filing firms acting as correspondence intermediaries, necessitating foreign filing firms to refer clients seeking U.S. trademark registration to be represented by attorneys licensed to practice in the United States for all submissions to the USPTO. However, the USPTO has evidence to suggest that you and your employees continued to practice before the Office <\/span><span style=\"font-size: 12pt;\">and conspired with others to circumvent the USPTO Rules by improperly entering the signatures of others and providing false, fictitious, and\/or fraudulent information in trademark applications.<\/span><\/p>\n<p><span style=\"font-size: 12pt;\">Since last year, users must register for and use a MyUSPTO account to access electronic forms and submit trademark documents through the Trademark Electronic Application System (\u201cTEAS\u201d). Your name appears in registrations for three different MyUSPTO accounts, registered to the email addresses 1090194565@qq.com, sztmlaw@hotmail.com, and paralegal1@tbchadwick.com. Office records reflect that your accounts are responsible for filing over 8,000 pending trademark applications, and that <\/span><span style=\"font-size: 12pt;\">users of your accounts have filed amendments and responsive documents in many more trademark application and registration records, despite the fact that you are not an attorney and not otherwise authorized to make submissions on behalf of others in trademark matters.<\/span><\/p>\n<p><span style=\"font-size: 12pt;\">Information about the submissions made from your MyUSPTO accounts indicate that the same person or entity is using these accounts to enter signatures of others. While the documents routinely appear to have been electronically signed by applicants or attorneys directly on the electronic form, the fact that the submissions are often filed in rapid succession and are signed by different individuals with mailing addresses in diverse <\/span><span style=\"font-size: 12pt;\">geographic regions is strong evidence that you or your employees must be entering the electronic signatures of others on the TEAS forms. For example, during a one-hour time period between 2:29 a.m. (Eastern) and 3:29 a.m. on May 14, 2021, one of your MyUSPTO accounts was responsible for submitting four new TEAS Plus applications and five responses to Office actions, each with a declaration attached and identifying a total of seven different alleged signatories who, according to the TEAS forms, personally entered their electronic signatures.<\/span><\/p>\n<p><span style=\"font-size: 12pt;\">&#8230; It is implausible that each signatory, allegedly <\/span><span style=\"font-size: 12pt;\">located thousands of miles from each other, was present to personally enter their electronic signatures on these TEAS forms during the same single hour.<\/span><\/p>\n<p><span style=\"font-size: 12pt;\">Your MyUSPTO accounts are also responsible for filing TEAS submissions at a frequency that would make it improbable and likely impossible for a single person to fill out the forms, <\/span><span style=\"font-size: 12pt;\">let alone coordinate the personal entry of electronic signatures on TEAS forms by seemingly unrelated parties. On March 16, 2021, alone, your accounts were responsible for filing 201 different TEAS forms, most within minutes of each other, with several submitted mere seconds apart&#8230;Based on the volume and speed of submissions originating from your accounts, we presume that you are sharing access to your MyUSPTO accounts with others in violation of the Terms of Use for USPTO Websites.<\/span><\/p>\n<p><span style=\"font-size: 12pt;\">&#8230;<\/span><\/p>\n<p><span style=\"font-size: 12pt;\">Further, you and your employees are also responsible for submitting several hundred applications identifying the owners as juristic entities formed in the United States, but <\/span><span style=\"font-size: 12pt;\">containing false domicile information. The USPTO received hundreds of new applications filed in the name of companies such as \u201cAlpharerry Inc,\u201d \u201cBluedeep Trade Inc,\u201d \u201cChengde <\/span><span style=\"font-size: 12pt;\">International Trading LLC,\u201d \u201cDiubl LLC,\u201d \u201cOTBBA LLC,\u201d \u201cJincheng Inc,\u201d \u201cKingheng Inc,\u201d \u201cVanjo LLC,\u201d \u201cFiberhome Technology Co., Ltd.,\u201d \u201cQianxing Fenghui LLC,\u201d \u201cRyhom LLC,\u201d \u201cFlycamp Trading LLC,\u201d \u201cSuntravel Trading LLC,\u201d \u201cZhishan Industrial Inc,\u201d \u201cVirfine Trade Inc,\u201d \u201cXinxiu Family Inc,\u201d \u201cHCLife LLC,\u201d \u201cWoxeon Technology Inc,\u201d \u201cWector Home America LLC,\u201d \u201cFengshun LLC,\u201d \u201cYifan LLC,\u201d \u201cPromotion Inc,\u201d \u201cPerfso Trade Inc,\u201d and \u201cPTTAGING LLC,\u201d initially claiming to be California entities with a domicile address of \u201c18351 Colima <\/span><span style=\"font-size: 12pt;\">Road, Rowland Heights, CA.\u201d4 When challenged by examining attorneys, responses originating from your accounts often change the state of formation\/incorporation to Colorado, and list a new domicile address of \u201c6547 North Academy Blvd, Colorado Springs, CO.\u201d<\/span><\/p>\n<p><span style=\"font-size: 12pt;\">Both the Rowland Heights and Colorado Springs addresses are merely commercial mail receiving agencies, capable of forwarding or scanning mail for people or entities located <\/span><span style=\"font-size: 12pt;\">elsewhere in the world. These addresses are not valid domicile addresses for these applicants. Only when challenged further have you or your employees designated attorneys Shan Zhu or Yi Wan and provided domicile information that suggests the <\/span><span style=\"font-size: 12pt;\">applicants are actually located outside the United States. &#8230; Based upon the multiple attempts to provide false domicile information for entities located outside the United States, and the reluctance to list an attorney of record until challenged, the USPTO can only conclude that you and your employees have been providing false, fictitious, and\/or fraudulent information to the USPTO in an effort to obfuscate the applicants\u2019 foreign domicile addresses with the intent to circumvent the requirement for U.S. counsel&#8230;\u00a0<\/span><\/p>\n<p><span style=\"font-size: 12pt;\"><strong>Based on the foregoing, the USPTO has reason to believe that all applications and trademark documents filed via your MyUSPTO accounts were filed in violation of the <\/strong><\/span><span style=\"font-size: 12pt;\"><strong>USPTO Rules and are <span style=\"text-decoration: underline;\">invalid<\/span>.<\/strong> The applications and documents were not properly signed, appear to have been submitted without the owner or any identifiable authorized person <\/span><span style=\"font-size: 12pt;\">making reasonable inquiry into the factual contentions contained therein, and likely contain false, fictitious, and\/or fraudulent information. Available information also indicates <\/span><span style=\"font-size: 12pt;\">that such submissions were filed with an intention to circumvent the USPTO Rules including, but not limited to, 37 C.F.R. \u00a7\u00a7 2.11(a), 2.193, 11.14, and 11.18(b). In addition, <\/span><span style=\"font-size: 12pt;\">USPTO records indicate that these submissions were made using the MyUSPTO system and TEAS in contravention of the Terms of Use for USPTO Websites. <\/span><\/p>\n<\/blockquote>\n<p>The USPTO listed sanctions are:<\/p>\n<blockquote>\n<p><span style=\"font-size: 12pt;\">(1) Permanently precluding you and your employees from submitting <\/span><span style=\"font-size: 12pt;\">trademark-related documents on behalf of yourselves or others;<\/span><br \/>\n<span style=\"font-size: 12pt;\">(2) Striking or otherwise giving no weight to all trademark-related <\/span><span style=\"font-size: 12pt;\">documents submitted by you or your employees;<\/span><br \/>\n<span style=\"font-size: 12pt;\">(3) Removing correspondence information associated with you and your <\/span><span style=\"font-size: 12pt;\">employees from the USPTO\u2019s database in all applications and\/or <\/span><span style=\"font-size: 12pt;\">registrations;<\/span><br \/>\n<span style=\"font-size: 12pt;\">(4) Directing the USPTO\u2019s Office of the Chief Information Officer to <\/span><span style=\"font-size: 12pt;\">permanently deactivate any USPTO accounts in which contact information <\/span><span style=\"font-size: 12pt;\">related to you or your employees appears, and to take all reasonable efforts <\/span><span style=\"font-size: 12pt;\">to prevent you or your employees from creating or activating further <\/span><span style=\"font-size: 12pt;\">accounts;<\/span><br \/>\n<span style=\"font-size: 12pt;\">(5) Terminating all ongoing proceedings containing submissions filed by you or your employees, specifically, abandoning all trademark applications filed via MyUSPTO accounts registered to you or your employees, as the <\/span><span style=\"font-size: 12pt;\">applications were apparently filed for improper purposes; and<\/span><br \/>\n<span style=\"font-size: 12pt;\">(6) Continuing to strike documents, remove information, deactivate <\/span><span style=\"font-size: 12pt;\">accounts, and terminate proceedings containing submissions later found to <\/span><span style=\"font-size: 12pt;\">have been filed by your or your employees. <\/span><\/p>\n<\/blockquote>\n<p>The deadline for Huanyee to respond is June 22, 2021.\u00a0 No word yet whether Huanyee responded but in the meantime, their website is down but their WeChat social media account is still active.\u00a0<\/p>\n<p>Huanyee was presumably trying to avoid the costs of retaining a U.S. lawyer in order to profit from government incentives for trademark registrations as <a href=\"https:\/\/www.chinaiplawupdate.com\/2021\/01\/uspto-releases-report-on-distortions-caused-by-chinese-monetary-incentives-for-u-s-filings\/\">as earlier reported by the USPTO<\/a>. In fact, in April 2021, <a href=\"https:\/\/mp.weixin.qq.com\/s\/n_VwS_3VYg7RraHAFpx3ww\">Huanyee explained in a social media account posting<\/a> Shenzhen&#8217;s policy for trademark subsidies of up to 3,000 RMB (~$464 USD)\u00a0 per trademark.\u00a0 \u00a0It is unclear if applicants will need to repay the subsidies if the trademarks are invalidated.<\/p>\n<p>Due to the sheer number of trademark applications listed in two columns over 107 single-spaced pages, this Order has also been subject of much commentary in Chinese social media postings (e.g., <a href=\"https:\/\/mp.weixin.qq.com\/s\/ADni1kRlnXxvZr9QgHMxow\">here<\/a> and <a href=\"https:\/\/mp.weixin.qq.com\/s\/xetPCridqPbum-Tz8deubw\">here<\/a>).\u00a0<\/p>\n<p>The full text of the Order is available <a href=\"https:\/\/www.uspto.gov\/sites\/default\/files\/documents\/TM-Show-Cause-order-In-re-Yusha-Zhang.pdf\">here<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p class=\"excerpt\">Update: The USPTO has extended the deadline for Huanyee to respond to July 6, 2021.
