{"id":2764,"date":"2023-11-06T19:14:48","date_gmt":"2023-11-06T19:14:48","guid":{"rendered":"https:\/\/www.chinaiplawupdate.com\/?p=2764"},"modified":"2023-11-06T19:14:48","modified_gmt":"2023-11-06T19:14:48","slug":"chinas-national-peoples-congress-releases-translation-of-criminal-law-including-ip-provisions","status":"publish","type":"post","link":"https:\/\/www.chinaiplawupdate.com\/2023\/11\/chinas-national-peoples-congress-releases-translation-of-criminal-law-including-ip-provisions\/","title":{"rendered":"China&#8217;s National People&#8217;s Congress Releases Translation of Criminal Law Including IP Provisions"},"content":{"rendered":"<p><a href=\"http:\/\/www.npc.gov.cn\/npc\/index.html\">China&#8217;s National People&#8217;s Congress<\/a> has recently released a <a href=\"http:\/\/en.npc.gov.cn.cdurl.cn\/2020-12\/26\/c_921604.htm\">translation of China&#8217;s Criminal Law<\/a>, which includes many Intellectual Property provisions.\u00a0 The Criminal Law was most recently amended at 24th Meeting of the Standing Committee of the Thirteenth National People\u2019s Congress on December 26, 2020 and went into force on March 1, 2021. <a href=\"https:\/\/www.chinaiplawupdate.com\/2020\/12\/chinas-national-peoples-congress-passes-amended-criminal-law-adding-an-economic-espionage-article-and-increasing-prison-time-for-intellectual-property-crimes\/\">The amendments<\/a> increase the maximum sentencing term for IP crimes and also add a new article somewhat similar to the US\u2019 <a href=\"https:\/\/www.justice.gov\/archives\/jm\/criminal-resource-manual-1122-introduction-economic-espionage-act\">Economic Espionage Act<\/a> potentially in effect if not in wording. For ease of reference, a translation of the IP provisions follow. The full translation is available <a href=\"http:\/\/en.npc.gov.cn.cdurl.cn\/2020-12\/26\/c_921604.htm\">here<\/a>.<!--more--><\/p>\n<p>Section 7<\/p>\n<p>Crimes of Infringing on Intellectual Property Rights<\/p>\n<p>Article 213\u00a0Whoever, without permission of\u00a0the right holder of a registered trademark, uses a trademark representation\u00a0which is identical with the registered trademark on the same kind of commodities or services, if the circumstances are serious, shall be sentenced to fixed-term imprisonment of not more than 3\u00a0years, and concurrently, a fine, or shall be sentenced to a fine\u00a0only. If\u00a0the circumstances are especially\u00a0serious, the offender shall be sentenced to fixed-term imprisonment of not less than 3\u00a0years but not more than 10 years, and concurrently, a fine.<\/p>\n<p>Article 214\u00a0Whoever knowingly sells counterfeit commodities bearing another\u2019s registered trademark, if the amount of illegal gains is relatively large or there are other serious circumstances, shall be sentenced to fixed-term imprisonment of not more than 3\u00a0years, and concurrently, a fine, or shall be sentenced to a fine\u00a0only. If\u00a0the amount of illegal gains is large, or there are other especially\u00a0serious circumstances, the offender shall be sentenced to fixed-term imprisonment of not less than 3\u00a0years but not more than 10 years,\u00a0and concurrently, a fine.<\/p>\n<p>Article 215\u00a0Whoever forges, or makes without authorization\u00a0of the right holder,\u00a0representations of a\u00a0registered\u00a0trademark, or sells such representations, if the circumstances are serious, shall be sentenced to fixed-term imprisonment of not more than 3\u00a0years, and concurrently, a fine, or shall be sentenced to a fine only. If\u00a0the circumstances are especially\u00a0serious, the offender shall be sentenced to fixed-term imprisonment of not less than 3\u00a0years but not more than 10 years, and concurrently, a fine.<\/p>\n<p>Article 216\u00a0Whoever uses\u00a0the patent of another\u00a0without authorization, if the circumstances are serious, shall be sentenced to fixed-term imprisonment of not more than 3\u00a0years or short-term custody, and concurrently, a fine, or shall be sentenced to a fine only.<\/p>\n<p>Article 217\u00a0Whoever, for\u00a0the purpose of making profits, commits any of the following acts infringing on copyrights or copyright-related rights, if the amount of illegal gains is relatively large or there are other serious circumstances, shall be sentenced to fixed-term imprisonment of not more than 3\u00a0years, and concurrently, a fine, or shall be sentenced to a fine only. If\u00a0the amount of illegal gains is large or there are other especially\u00a0serious circumstances, the offender shall be sentenced to fixed-term imprisonment of not less than 3\u00a0years but not more than 10 years, and concurrently, a fine:<\/p>\n<p>(1) reproducing,\u00a0distributing, or disseminating to the public through information network\u00a0the\u00a0written works, music, works\u00a0of fine arts, audiovisual\u00a0works, computer software,\u00a0or other works\u00a0prescribed by laws or administrative regulations,\u00a0without permission of\u00a0the copyright owner;<\/p>\n<p>(2) publishing a book of which the exclusive right of publication is enjoyed by another;<\/p>\n<p>(3) reproducing, distributing, or disseminating to the public through information network\u00a0a sound or video recording,\u00a0without permission of\u00a0the producer;<\/p>\n<p>(4)\u00a0reproducing or distributing sound or video recordings of a performance or making the performance available\u00a0to the public through information network, without permission of\u00a0the performer;<\/p>\n<p>(5) producing or selling a work of fine art with a forged signature of a painter; or<\/p>\n<p>(6) intentionally circumventing or destroying the technological measures which are adopted by a copyright owner or copyright-related right holder to protect the copyright or copyright-related rights on a work or on a sound or video recording, etc., without permission\u00a0of the\u00a0copyright owner or copyright-related right holder.<\/p>\n<p>Article 218\u00a0Whoever, for the purpose of making profits, knowingly sells works reproduced which\u00a0infringe\u00a0on the copyright or copyright-related rights\u00a0as mentioned in Article 217 of this Law, if the amount of illegal gains is large\u00a0or there are other serious circumstances, shall be sentenced to fixed-term imprisonment of not more than 5 years, and concurrently, a fine, or shall be sentenced to a fine only.<\/p>\n<p>Article 219\u00a0Whoever commits any of the following acts infringing on business secrets, if the circumstances are serious,\u00a0shall be sentenced to fixed-term imprisonment of not more than 3\u00a0years, and concurrently, a fine, or shall be sentenced to a fine only. If\u00a0the circumstances are especially\u00a0serious, the offender shall be sentenced to fixed-term imprisonment of not less than 3\u00a0years but not more than 10 years, and concurrently, a fine:<\/p>\n<p>(1) obtaining a right holder\u2019s\u00a0business secrets by theft,\u00a0bribing, fraud,\u00a0coercion, electronic intrusion,\u00a0or by any other unjustifiable\u00a0means;<\/p>\n<p>(2) disclosing, using,\u00a0or allowing another to use the business secrets obtained from the right holder by the means as mentioned in the preceding paragraph; or<\/p>\n<p>(3) disclosing, using,\u00a0or allowing another to use the business secrets one has learned, by breaching his confidentiality obligation or by going\u00a0against the right holder\u2019s demand for keeping said business secrets\u00a0confidential.<\/p>\n<p>Whoever, knowing\u00a0that the business secrets fall under\u00a0the circumstances\u00a0specified in the preceding paragraph,\u00a0obtains, discloses,\u00a0uses, or allows\u00a0another to use\u00a0such business secrets, shall be deemed an offender who infringes on business secrets.<\/p>\n<p>Right holders\u00a0as mentioned in this Article refer to the owner\u00a0of\u00a0business secrets and the\u00a0authorized\u00a0users\u00a0of the business secrets.<\/p>\n<p>Article 219a\u00a0Whoever\u00a0acquires through theft\u00a0or\u00a0spying, or illegally purchases\u00a0or provides business secrets for an overseas institution, organization or individual shall be sentenced to\u00a0fixed-term imprisonment of not more than 5 years, and concurrently, a fine, or shall be sentenced to a fine only.
